Clean Records Are Back on the Table

President Biden’s EO would re-establish clean records agreements and directs the Office of Personnel Management to go through the rulemaking process to implement this change.

DePriest hopes that agencies will move forward with clean records agreements immediately and not wait for the regulation to be officially rescinded – or at least restore the practice so that clean records “would go into effect as soon as the regulation is officially rescinded.” He explained that clean records agreements benefit agencies as well as employees and reduce unnecessary litigation.
