KCNF partner Elisabeth Baker-Pham recently joined a panel discussion on the legal realities contractors face in the security clearance process at ClearanceJobs Connect, a national conference for cleared professionals and employers. The session, “Legal Concerns in Contracting: What Cleared Employers and Candidates Need to Know,” explored emerging risks and best practices for maintaining clearance eligibility in today’s evolving national security landscape.
Baker-Pham shared insights on some of the most common issues affecting cleared employees and applicants, including marijuana and CBD use, financial concerns, and personal conduct. She emphasized that while policies around drug use are shifting, federal law continues to treat marijuana as illegal.
Baker-Pham also underscored that full and accurate disclosure on the SF-86 or e-QIP is critical. “Omitting facts can create bigger problems than honest mistakes. The best way to protect yourself is to be upfront and contextualize your actions.” Baker-Pham encouraged both employees and employers to approach these cases with transparency and to seek knowledgeable counsel early in the process.
The session provided practical guidance for contractors navigating challenges such as an employee’s clearance being suspended or revoked mid-contract. Baker-Pham discussed the importance of exploring all available options, including temporary reassignment, to help retain valued employees while maintaining compliance.
