Aaron Herreras Szot Discusses Federal Employee Deferred Resignation Program on CNN

KCNF’s Aaron Herreras Szot, a federal employment lawyer, appeared on CNN News Central to discuss the legal uncertainties surrounding the Trump administration’s federal deferred resignation program. In an interview with CNN’s Sara Sidner, Szot shed light on the concerns of federal workers who accepted the program’s offer and now face an uncertain legal landscape.

The deferred resignation program, the deadline for which has been temporarily stayed by a federal judge, has left thousands of federal employees questioning their next steps. Those who accepted the resignation offer now fear that if the program is ultimately struck down, they could lose their jobs without recourse. Szot, who represents multiple federal employees affected by the program, emphasized that uncertainty is the central issue.

“What appeared as a benefit on its face actually has a lot of ambiguity, that hopefully the district court will clear up shortly,” Szot explained. She noted that some employees who accepted the deal are concerned due to the program’s legal and financial unpredictability.

Sidner asked whether the Trump administration could simply fire federal employees who attempt to withdraw their resignation. Szot clarified that most federal employees have due process protections, meaning terminations must be evaluated on a case-by-case basis to determine their legality. However, she also pointed out that agency discretion plays a significant role, as reassignment, consolidation, or administrative leave could be cited as reasons to deny an employee’s request to rescind their resignation.

Beyond employment concerns, Szot warned of the potential constitutional implications if the executive branch disregards judicial rulings. “Ultimately, judicial orders are binding on all parties. If one branch of government decides to ignore another, that is teeing up a constitutional issue,” she stated.

As this legal battle unfolds, Kalijarvi, Chuzi, Newman & Fitch remains committed to advocating for federal employees’ rights and ensuring they receive the legal protections they deserve.
