KCNF continues the legal battle on behalf of federal workers whose jobs have been unlawfully terminated under the Trump administration’s sweeping efforts. As featured in Law360 Pulse, KCNF Managing Partner Elaine Fitch underscored the significance of this moment: “It does feel like it’s a way to try to preserve our democracy by protecting our government and protecting the rule of law.”
With a long history of advocating for federal employees, KCNF is now representing numerous former high-level officials and civil servants, including Colette Peters, the former Director of the U.S. Bureau of Prisons, as well as Foreign Service Officers at USAID. These cases come amid mass layoffs, agency overhauls, and efforts to dismantle longstanding federal protections — moves that Fitch and others believe represent a flagrant disregard for legal procedures and due process.
“Sometimes [past administrations would] make a mistake and you’d get them on a due process or a procedural violation, but they were still, for all intents and purposes, intending to follow the law,” Fitch told Law360. “And here, there’s just flagrant disregard for the law, for the regulations. There’s a few things that they’re doing correctly, but for the most part, we all know that the goal is just to get rid of as much of the federal government as possible.”
KCNF attorneys are actively filing class action appeals before the Merit Systems Protection Board (MSPB), a venue traditionally used for individual employment disputes but now being called upon to address government-wide job cuts. The firm is working alongside a coalition of law firms and civil rights organizations across the country to challenge these actions and uphold the rule of law.
“We are seeing an unprecedented number of terminations and legal violations,” said Fitch. “But we are not backing down. Our mission remains clear: protect our clients, defend their rights, and ensure that the federal government remains accountable to the laws that govern it.”
